AN ACT in relation to the alienation of certain parklands in the village
of Kings Point in the county of Nassau
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subject to the provisions of this act, the village of Kings
2 Point, located in the county of Nassau, is hereby authorized to discon-
3 tinue and alienate as parkland the lands described in section four of
4 this act.
5 § 2. Notwithstanding the failure of the village of Kings Point to seek
6 and receive state legislative authorization to alienate certain park-
7 lands as described in section four of this act prior to the parklands
8 being alienated, such alienation is hereby validated, legalized, rati-
9 fied and confirmed.
10 § 3. The authorization provided in section one of this act shall be
11 effective only upon the condition that the village of Kings Point, coun-
12 ty of Nassau, dedicates the lands described in section five of this act
13 as parkland and installs a fence delineating the boundaries of the park-
14 land authorized to be alienated pursuant to section four of this act.
15 § 4. The parklands authorized by section one of this act to be alien-
16 ated are described as follows:
17 All that certain plot, piece or parcel of land, with the buildings and
18 improvements thereon erected, situate, lying and being in the Incorpo-
19 rated Village of Kings Point, Town of North Hempstead, County of Nassau
20 and State of New York, bounded and described as follows:
21 BEGINNING at a point on the southeasterly line of Kings Point Road, said
22 point being distant 454.15 feet northeasterly as measured along said
23 line from the corner formed by the intersection of the northerly line of
24 Steamboat Road (Elm Point Road) with the southeasterly line of Kings
25 Point Road;
26 RUNNING THENCE from said point of beginning the following ten (10)
27 courses, the first course being along Kings Point Road;
28 1. North 32° 58' 20" East, a distance of 265.83 feet;

14 § 5. Prior to the discontinuance and alienation of the parkland
15 described in section four of this act, the village of Kings Point shall
16 dedicate as parkland such land described as follows:

18 All that certain plot, piece or parcel of land situate, lying a being
19 in the incorporated Village of Kings Point, Town of North Hempstead,
20 County of Nassau and State of New York, bounded and described as
21 follows:
22 BEGINNING at a point on the easterly line of East Shore Road, as
23 widened, at the division line between Lot 32 and Lot 35 in Block 172;
24 RUNNING THENCE from said point of beginning North 89° 42' 24" East
25 along said division line, a distance of 148.66 feet to the mean high
26 water line of Manhasset Bay;
27 THENCE the following fifteen (15) courses;
28 1. South 59° 48' 00" West, a distance of 58.80 feet;
29 2. North 89° 28' 41" East, a distance of 354.96 feet;
30 3. South 23° 32' 26" West, a distance of 234.56 feet;

11 distance of 27.89 feet to the mean high water line of Manhasset Bay;

38 2. North 78° 22' 30" East, a distance of 114.01 feet;
39 3. South 11°37'30 East, a distance of 67.11 feet;
40 4. South 78°22'30 West, a distance of 119.92 feet;
41 5. South 89°22'41 West, a distance of 18.00 feet;
42 6. South 81°36'22 East, a distance of 63.89 feet;

51 Lots 12A & B, Lot 13 and Lot 14 in Block 184, Section 1 of the Nassau
52 County Land and Tax Map, and containing within said bounds 19,147 Sq.
53 Ft. or 0.439 Acres, more or less. All three parcels together containing
54 within their said bounds 6.642 acres more or less.
55 § 6. In the event that the parklands to be dedicated by the village of
56 Kings Point pursuant to this act are not equal to or greater than the

1 fair market value of the parkland to be discontinued, the village of
2 Kings Point shall dedicate the difference of the fair market value of
3 the lands to be alienated and the lands to be dedicated for the acquisi-
4 tion of additional parklands and/or capital improvements to existing
5 park and recreational facilities.
6 § 7. If the parkland that is subject to this act has received funding
7 pursuant to the federal land and water conservation fund, the discontin-
8 uance of parkland authorized by the provisions of this act shall not
9 occur until the municipality has complied with the federal requirements
10 pertaining to the conversion of parklands, including satisfying the
11 secretary of the interior that the discontinuance will include all
12 conditions which the secretary of the interior deems necessary to assure
13 the substitution of other lands shall be equivalent in fair market value
14 and recreational usefulness to the lands being discontinued.
15 § 8. This act shall take effect immediately.
