          read once and referred to the Committee on Racing and Wagering
 
        AN ACT to amend the racing, pari-mutuel wagering and  breeding  law,  in
          relation to distributing purse monies more equitably
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Subdivision 9 of section 208  of  the  racing,  pari-mutuel
     2  wagering  and  breeding  law is amended by adding a new paragraph (f) to
     3  read as follows:
     4    (f) Notwithstanding any other law  to  the  contrary,  the  franchised
     5  corporation or the horsemen's bookkeeper shall not allocate or spend any
     6  monies  from an account established pursuant to this section without the
     7  prior written consent of the New York  thoroughbred  horsemen's  associ-
     8  ation  representing at least fifty-one percent of the horsemen using the
     9  facilities of the franchised corporation, provided however, any  payment
    10  obligation provided for in law from the accounts established pursuant to
    11  this section shall not require written consent.
    12    § 2. This act shall take effect immediately.
