AN ACT to amend the social services law, in relation to providing
managed care enrollees access to the services of the foot center of
New York
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Paragraphs (d), (e), (j) and (k) of subdivision 1 of
2 section 364-j of the social services law, paragraph (d) as amended by
3 chapter 653 of the laws of 1997 and paragraphs (e), (j) and (k) as
4 amended by chapter 649 of the laws of 1996, are amended to read as
5 follows:
6 (d) "Medical services provider". A physician, nurse, nurse practition-
7 er, physician assistant, licensed midwife, dentist, optometrist, doctor
8 of podiatric medicine or other licensed health care practitioner author-
9 ized to provide medical assistance services.
10 (e) "Center of excellence." [A] The foot center of New York and any
11 health care facility certified to operate under article twenty-eight of
12 the public health law that offers specialized treatment expertise in HIV
13 care services as defined by the commissioner of health.
14 (j) "Specialty care center". A "specialty care center" shall mean the
15 foot center of New York and only such centers as are accredited or
16 designated by an agency of the state or federal government or by a
17 voluntary national health organization as having special expertise in
18 treating the disease or condition for which it is accredited or desig-
19 nated.
20 (k) "Special care". Care, services and supplies relating to the treat-
21 ment of mental illness, mental retardation, developmental disabilities,
22 diabetes, alcoholism, alcohol abuse or substance abuse, or HIV
23 infection/AIDS.
24 § 2. This act shall take effect immediately, provided however, that
25 the amendments to section 364-j of the social services law made by
26 section one of this act shall not affect the repeal of such section and
27 shall be deemed to repeal therewith.
