          printed to be committed to the Committee on Education
 
        AN  ACT  to  amend  the  education  law, in relation to notice to school
          districts regarding intent to attend a charter school
 

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Subdivision  2  of  section  2854 of the education law is
     2  amended by adding a new paragraph (e) to read as follows:
     3    (e) A parent or guardian of a child residing in any  school  district,
     4  or any representative authorized by such parent or guardian, who desires
     5  for  a  child  to  attend a charter school shall submit a written notice
     6  thereof to the school trustees or board of education  of  such  district
     7  not  later  than  the first day of April preceding the next school year,
     8  and in the case where such pupil  attends  a  nonpublic  school,  notice
     9  shall also be provided to such nonpublic school, provided, however, that

    10  a  parent  or  guardian  of a child not residing in the district on such
    11  date shall submit a written notice within thirty days after establishing
    12  residence in the district.
    13    § 2. This act shall take effect immediately.
