AN ACT to amend the general municipal law, in relation to creating
community advisory councils for special needs housing
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The general municipal law is amended by adding a new arti-
2 cle 12-I to read as follows:

4 SPECIAL NEEDS HOUSING COMMUNITY ADVISORY COUNCILS
5 Section 239-gg. Special needs housing community advisory councils.
6 § 239-gg. Special needs housing community advisory councils. 1. For
7 purposes of this article, the following terms are defined as follows:
8 (a) "Special needs housing community advisory council" or "community
9 advisory council" means a group of not less than five and not more than
10 twenty persons, established by a covered facility to discuss issues
11 affecting the facility and advise the covered facility on how best to
12 facilitate productive communication and collaboration between the
13 covered facility and its residents and the local community.
14 (b) "Covered authority" means the local municipal housing authority
15 where applicable, or the local municipal corporation.
16 (c) "Covered facility" means (i) a residence operated by or on behalf
17 of the local homeless action services; or (ii) an emergency residence
18 operated by or on behalf of the local social services agency or human
19 resources administration, which is available primarily for homeless
20 persons with HIV or AIDS-related illnesses.

1 2. Each covered authority shall require all covered facilities to
2 establish and maintain a special needs housing community advisory coun-
3 cil.
4 3. In establishing a community advisory council, a covered facility
5 will invite local not-for-profit social service providers, members of
6 the business community, representatives of faith-based community organ-
7 izations, elected officials, members of municipal corporation's supervi-
8 sory boards, representatives of the municipal housing authority, covered
9 facility residents and other concerned members of the community to
10 participate.
11 4. At a minimum, community advisory councils established pursuant to
12 this article will meet on a quarterly basis.
13 5. Within forty-five days of the effective date of this article, every
14 covered facility in operation shall submit a certification to the appro-
15 priate covered authority indicating that it will establish and maintain
16 a community advisory council as required by this article. Within forty-
17 five days of commencing its activities any covered facility that
18 commences operation after the effective date of this article shall
19 submit a certification to the appropriate covered agency indicating that
20 it will establish and maintain a community advisory council as required
21 by this article.
22 § 2. This act shall take effect on the one hundred eightieth day after
23 it shall have become a law.
