        Introduced  by Sen. BENJAMIN -- read twice and ordered printed, and when
          printed to be committed to the Committee on Housing, Construction  and
          Community Development
 
        AN  ACT  providing for the office of temporary and disability assistance
          to provide rental assistance to individuals with a loss of ability  to
          pay rent as a result of COVID-19; and providing for the repeal of such
          provisions upon the expiration thereof
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Notwithstanding any provision of law to the  contrary,  for
     2  the duration of the state disaster emergency declared pursuant to execu-
     3  tive  order  202 of 2020, and as extended by any future executive order,
     4  the office of temporary and disability assistance may  provide  singular
     5  instances  of  rental  assistance  to  individuals  who can sufficiently
     6  demonstrate a loss of ability to pay rent as a result of COVID-19.  Loss
     7  of  ability to pay rent as a result of COVID-19 may be demonstrated by a
     8  certification of risk for eviction from a court of  competent  jurisdic-
     9  tion,  but  such  certification  shall  not  be a requirement to receive
    10  rental assistance.
    11    § 2. This  act  shall  take  effect  immediately,  provided  that  the
    12  provisions  of  this act shall expire and be deemed repealed on the date
    13  the state disaster emergency declared pursuant to executive order 202 of
    14  2020, and as extended by any future executive order, is lifted; provided
    15  that the commissioner of the office of temporary and disability  assist-
    16  ance  shall  notify  the  legislative  bill drafting commission upon the
    17  lifting of the state disaster emergency declared pursuant  to  executive
    18  order  202  of  2020,  and as extended by any future executive order, in
    19  order that the commission may maintain an accurate and timely  effective
    20  data  base  of the official text of the laws of the state of New York in
    21  furtherance of effectuating the provisions of section 44 of the legisla-
    22  tive law and section 70-b of the public officers law.
