        Introduced  by  Sen.  DUANE  -- read twice and ordered printed, and when
          printed to be committed to the Committee on Transportation
 
        AN ACT to amend the public authorities law, in relation to the expansion
          and electrification of preexisting railroad lines
 
          The People of the State of New York, represented in Senate and  Assem-

        bly, do enact as follows:
 
     1    Section  1.  Section  1266 of the public authorities law is amended by
     2  adding a new subdivision 19 to read as follows:
     3    19. Notwithstanding the provisions of any other law, general,  special
     4  or  local,  rule or regulation to the contrary, prior to the implementa-
     5  tion of any plan which would cause a preexisting railroad line which  is
     6  within one thousand feet of residential property or a school to be elec-
     7  trified for the purpose of expanding service on said line, the authority
     8  shall  be  required  to  hold at least one public hearing and after such
     9  hearing attain the approval of the majority of the members of the commu-
    10  nity planning board from the affected community.
    11    § 2. This act shall take effect immediately.
