AN ACT to amend the state technology law, in relation to creating the
resultsNY.gov website
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Legislative findings and declaration. The legislature here-
2 by finds and declares that many New York state agencies currently
3 provide valuable information to the public regarding policy issues and
4 government programs and initiatives. However, the public would clearly
5 benefit by having website access to important performance-based statis-
6 tics, policy issues and comparative information on a user-friendly "one
7 stop shopping" basis. Such a website would dramatically expand public
8 access to useful information and enable taxpayers to more readily review
9 and better understand the many state programs that affect the quality of
10 life such as public safety, education, energy, transportation, housing,
11 health, law enforcement and the environment. Additionally, it would
12 enhance government transparency and accountability while helping to
13 ensure the public that their taxes are being spent prudently.
14 Therefore, to achieve the above-stated intent, the legislature hereby
15 finds and declares that there be established the "resultsNY.gov" website
16 to be initiated, operated and maintained by the state office for tech-
17 nology with oversight authority by the committee on resultsNY.gov.
18 Patterned after the federal office of management and budget's Expect-

1 More.gov website, this proposal will establish a new, user-friendly
2 website that provides the public with the ability to review the perform-
3 ance of state government agencies and programs. ResultsNY.gov would
4 provide a new single access website, with specific indicators to help
5 the public determine how effectively tax dollars are being spent, and
6 how individual government programs are performing.
7 § 2. Section 103 of the state technology law is amended by adding a
8 new subdivision 22 to read as follows:
9 22. To request and receive from any department, division, board,
10 commission or other agency of the state, any information and resources
11 necessary to carry out the responsibilities and provisions set forth in
12 article four of this chapter.
13 § 3. Subdivisions 3 and 4 of section 105 of the state technology law,
14 as added by chapter 430 of the laws of 1997 and such section as renum-
15 bered by chapter 437 of the laws of 2004, are amended to read as
16 follows:
17 3. To recommend surveys and reports to be completed by the director to
18 carry out all of the objectives and purposes of this article; [and]
19 4. To provide guidance and support to the office in the development
20 and improvements to the format and content of resultsNY.gov; and
21 5. To perform such other acts as may be assigned by the chairperson of
22 the council which are necessary or appropriate to carry out the func-
23 tions of the council.
24 § 4. The state technology law is amended by adding a new article 4 to
25 read as follows:

28 Section 401. Short title.

31 § 401. Short title. This article shall be known and may be cited as
32 the "resultsNY.gov act".
33 § 402. Definitions. For the purposes of this article:
34 1. "Electronic" shall mean of or relating to technology having elec-
35 trical, digital, magnetic, wireless, optical, electromagnetic, or simi-
36 lar capabilities.
37 2. "Electronic record" shall mean information, evidencing any act,
38 transaction, occurrence, event, or other activity, produced or stored by
39 electronic means and capable of being accurately reproduced in forms
40 perceptible by human sensory capabilities.
41 3. "Governmental entity" shall mean any state department, board,
42 bureau, division, commission, committee, public authority, public bene-
43 fit corporation, council, office, or other governmental entity or offi-
44 cer of the state having statewide authority, except the state legisla-
45 ture, and any political subdivision of the state.
46 § 403. ResultsNY.gov. 1. The office, in cooperation and consultation
47 with the council, shall establish, maintain, update and operate the
48 resultsNY.gov website. The office may request from any governmental
49 entity such cooperation in furnishing it with information that shall
50 enable the office to carry out its duties pursuant to this section. All
51 governmental entities are authorized and directed to provide to the
52 office such cooperation, assistance, service, advice and electronic
53 records in a timely manner.
54 2. The office shall ensure the resultsNY.gov website shall provide to
55 the user of the website comparative data and statistics to identify the
56 state's performance regionally and nationally relating to, but not

1 limited to, the economy, education, public safety, energy, housing, and
2 the environment.
3 3. The office, in cooperation and consultation with the council, shall
4 collect from any and all governmental entities government management
5 accountability and performance data. Such data, at a minimum, shall
6 determine:
7 (a) does the program address a specific and existing problem, interest
8 or need;
9 (b) is the program designed so that it is not redundant or duplicative
10 of any other federal, state, local or private effort;
11 (c) does the program have a limited number of specific long-term
12 performance measures that focus on outcomes and meaningfully reflect the
13 purpose of the program;
14 (d) does the program have ambitious targets and timeframes for its
15 long-term measures;
16 (e) does the program, including program partners, achieve its annual
17 performance goals;
18 (f) are independent evaluations of sufficient scope and quality
19 conducted on a regular basis or as needed to support program improve-
20 ments and evaluate effectiveness and relevance to the problem, interest,
21 or need;
22 (g) are budget requests explicitly tied to accomplishment of the annu-
23 al and long-term performance goals, and are the resource needs presented
24 in a complete and transparent manner in the program's budget;
25 (h) does the program use strong financial management practices;
26 (i) has the program demonstrated adequate progress in achieving its
27 long-term performance goals; and
28 (j) does the program demonstrate improved efficiencies or cost effec-
29 tiveness in achieving program goals each year.
30 4. The office shall ensure the resultsNY.gov website shall enable
31 members of the public to submit suggestions and recommendations on how
32 to save taxpayer money, help eliminate wasteful spending, and operate
33 government more efficiently and cost effectively. Such suggestions shall
34 be reviewed by the office and displayed on the website.
35 § 5. This act shall take effect on the one hundred twentieth day after
36 it shall have become a law. Effective immediately, the addition, amend-
37 ment and/or repeal of any rule or regulation necessary for the implemen-
38 tation of this act on its effective date are authorized and directed to
39 be made and completed on or before such effective date.
