AN ACT to amend the state finance law, in relation to discretionary
buying thresholds
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivision 6 of section 163 of the state finance law, as
2 amended by chapter 569 of the laws of 2015, is amended to read as
3 follows:
4 6. Discretionary buying thresholds. Pursuant to guidelines established
5 by the state procurement council: the commissioner may purchase services
6 and commodities in an amount not exceeding eighty-five thousand dollars
7 without a formal competitive process; state agencies may purchase
8 services and commodities in an amount not exceeding fifty thousand
9 dollars without a formal competitive process; and state agencies may
10 purchase commodities or services from small business concerns or those
11 certified pursuant to articles fifteen-A and seventeen-B of the execu-
12 tive law, from preferred source providers pursuant to section one
13 hundred sixty-two of this article, or commodities or technology that are
14 recycled or remanufactured, or commodities that are food, including milk
15 and milk products, grown, produced or harvested in New York state in an
16 amount not exceeding two hundred thousand dollars without a formal
17 competitive process.
18 § 2. This act shall take effect immediately, provided that the amend-
19 ments to section 163 of the state finance law, made by section one of
20 this act, shall not affect the expiration and repeal of such section,
21 and shall expire and be deemed repealed therewith.
