        AN  ACT  to  amend  the  public  health  law,  in  relation to access to
          prescription drug coverage
 

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  The  public health law is amended by adding a new section
     2  2804-b to read as follows:
     3    § 2804-b. Residential health care facilities; access  to  prescription
     4  drug  coverage  under  the  elderly  pharmaceutical  insurance  coverage
     5  program. A residential health care facility shall ensure that a resident
     6  who is enrolled in the elderly pharmaceutical insurance coverage program
     7  (EPIC) under title three of article two of the elder law shall have  the
     8  opportunity  to  access  prescription  drug  coverage under EPIC for any
     9  covered drugs, as defined in subdivision  one  of  section  two  hundred

    10  forty-one of the elder law, dispensed to the resident by the residential
    11  health care facility.
    12    §  2. This act shall take effect on the first of January next succeed-
    13  ing the date on which it shall have become a law.
