        Introduced  by  Sen.  KRUGER  --  (at request of the State Commission on
          Public Integrity) -- read twice and ordered printed, and when  printed
          to be committed to the Committee on Finance
 
        AN  ACT to amend the public officers law, in relation to post-employment
          restrictions
 

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Subdivision 8-b of section 73 of the public officers law,
     2  as added by chapter 523 of the laws of  2004,  is  amended  to  read  as
     3  follows:
     4    8-b.  Notwithstanding  the provisions of subparagraphs (i) and (ii) of
     5  paragraph (a) of subdivision eight of this section, a former state offi-
     6  cer or employee may contract individually, or as a member or employee of
     7  a firm, corporation [or], association, or contractor or subcontractor to
     8  the federal government to render services to any state agency if,  prior
     9  to engaging in such service, the agency head certifies in writing to the
    10  [state  ethics]  commission on public integrity that such former officer

    11  or employee has expertise, knowledge or experience  with  respect  to  a
    12  particular  matter  which meets the needs of the agency and is otherwise
    13  unavailable at a comparable cost. Where  approval  of  the  contract  is
    14  required  under section one hundred twelve of the state finance law, the
    15  comptroller shall review and  consider  the  reasons  for  such  certif-
    16  ication.  The  [state ethics] commission on public integrity must review
    17  and approve all certifications made pursuant to this subdivision.
    18    § 2. This act shall take effect immediately.
