        Introduced  by  Sen.  YOUNG  -- read twice and ordered printed, and when

        AN  ACT to authorize the Brocton central school district to repay over a
          period of six years certain overpayments of state aid
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section 1. Notwithstanding any provision of law to the contrary, state
     2  aid  payments  in the amount of not more than eight hundred ten thousand
     3  eight hundred  ninety-three  dollars  ($810,893)  made  to  the  Brocton
     4  central  school  district  in  the 2004-2005 school year, which included
     5  excess payments of aid of which the district has been notified, and  for
     6  which  a  recovery must be made by the state through deduction of future
     7  aid payments, shall be reduced by deducting  one-sixth  of  such  excess
     8  payments  from  the  payments due to such school district and payable in

     9  the month of June in the years 2009, 2010, 2011, 2012,  2013  and  2014;
    10  provided,  however,  there shall be no interest penalty assessed against
    11  such district  or  collected  by  the  state;  provided,  further  that,
    12  notwithstanding  any other provision of this act, any pending payment of
    13  moneys due to such district as a prior year adjustment payable  pursuant
    14  to paragraph c of subdivision 5 of section 3604 of the education law for
    15  aid  claims  that had been previously paid in excess as current year aid
    16  payments and for which recovery of excess payments is to be made  pursu-
    17  ant  to  this section, shall be reduced at the time of actual payment by
    18  any remaining unrecovered balance  of  such  excess  payments,  and  the
    19  remaining  scheduled deductions of such excess payments pursuant to this
    20  act shall be reduced by the commissioner of  education  to  reflect  the

    21  amount so recovered.
    22    § 2. This act shall take effect immediately.
