Provides that digital or electronic representations of certain personal identification data and criminal history records are inter-changeable with the physical counterparts of such items.

AN ACT to amend the executive law, in relation to electronic equivalents
of certain personal identification and criminal history data
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivision 7 of section 837 of the executive law, as added
2 by chapter 399 of the laws of 1972 and such section as renumbered by
3 chapter 603 of the laws of 1973, is amended to read as follows:
4 7. Receive, process and file fingerprints, photographs and other
5 descriptive data for the purpose of establishing identity and previous
6 criminal record. Whenever any provision of law requires or permits the
7 submission, transmission, forwarding, retention, return or destruction
8 thereof, the terms "criminal record", "criminal history record", "fing-
9 erprints", "fingerprint cards", "photographs", "palmprints", "personal
10 appearance data", "handwriting samples", and "descriptive data" shall
11 mean and include digital or electronic images, impressions, representa-
12 tions or reproductions of such criminal record, criminal history record,
13 fingerprints, fingerprint cards, photographs, palmprints, photographic
14 plates or proofs, personal appearance data, handwriting samples and
15 descriptive data or any other related materials in the possession or
16 control of the division that may be used for the purpose of establishing
17 identity or previous criminal record;
18 § 2. This act shall take effect immediately.
