AN ACT to amend part L of chapter 60 of the laws of 2004 relating to
exempting parts used exclusively to maintain, repair, overhaul or
rebuild aircraft or services associated therewith from the sales and
compensating use tax, in relation to the effectiveness thereof
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 2 of part L of chapter 60 of the laws of 2004,
2 amending the tax law relating to exempting parts used exclusively to
3 maintain, repair, overhaul or rebuild aircraft or services associated
4 therewith from the sales and compensating use tax is amended to read as
5 follows:
6 § 2. This act shall take effect December 1, 2004, and shall apply to
7 sales made, services rendered and uses occurring on or after that date
8 in accordance with the applicable transitional provisions of sections
9 1106 and 1217 of the tax law[, and shall expire and be deemed repealed
10 December 1, 2009; the commissioner of taxation and finance shall be
11 immediately authorized to adopt and amend any rules or regulations and
12 issue any procedure, forms or instructions necessary to implement this
13 act on its effective date; furthermore, the commissioner of taxation and
14 finance, in conjunction with the commissioner of transportation, shall
15 review and analyze all statistical data available for such purposes of
16 determining the economic and revenue impact of the sales and use tax
17 exemptions provided in this act; such report shall include, but not be
18 limited to, any increases in aviation related employment, airplane main-
19 tenance, and increases in hangaring in New York state; such report shall
20 be transmitted to the governor, senate majority leader and speaker of
21 the assembly].
22 § 2. This act shall take effect immediately.
