AN ACT to amend the education law, in relation to requiring notification
to parents and guardians of the ability to opt out of the school's
release of information to military recruiters
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 305 of the education law is amended by adding a new
2 subdivision 56 to read as follows:
3 56. a. The commissioner shall require all school districts to provide
4 notice to each student and to the parent or guardian of each student
5 enrolled in the school district that, in accordance with federal law,
6 the student or the parent or guardian of the student may request that
7 the student's name, address, and telephone number not be released to
8 military recruiters. This notice shall:
9 (i) be included in a clear and conspicuous manner and in the same size
10 type as the other statements on the letter requesting emergency contact
11 information that is distributed by the school district to each student
12 or parent or guardian of the student; and
13 (ii) request that the student or the parent or guardian of the student
14 indicate whether the student's name, address, and telephone number are
15 to be released to military recruiters by checking either the box
16 "release contact information" or "do not release contact information".
17 b. On or before October first and March first of each school year, the
18 principal of each school shall submit a list to that school's local
19 educational agency that includes the name, address, and telephone number
20 of each student whose contact information is not to be released to mili-
21 tary recruiters.
22 § 2. This act shall take effect immediately.
