AN ACT to amend the public health law, in relation to ensuring ongoing
quality assurance measures for emergency medical and trauma care and
autopsy reports on deceased persons treated at trauma centers
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivision 4 of section 3066 of the public health law, as
2 added by chapter 449 of the laws of 2005, is amended to read as follows:
3 4. The department shall develop and periodically revise a comprehen-
4 sive emergency medical and trauma care plan with the advice of the state
5 emergency medical services council, the state emergency medical advisory
6 committee and the state trauma advisory committee, incorporating injury
7 control programs and ongoing quality assurance measures for all compo-
8 nents of the trauma system involved in trauma care.
9 § 2. The section heading of section 4210 of the public health law is
10 amended and a new subdivision 2-a is added to read as follows:
11 [Cadavers] Deceased persons; right to dissect.
12 2-a. Autopsy reports for patients treated at designated trauma centers
13 following injury shall be made available in a timely manner to the
14 referring trauma center. This information is required by the trauma
15 center in order to meet the criteria for ongoing performance improvement
16 required by the trauma center verification process. Such reports shall
17 be exempt from all actions pursuant to the civil practice law and rules.
18 § 3. This act shall take effect immediately.
