AN ACT to amend the executive law, in relation to the mandatory filing
of a verified notification form and certificate of security informa-
tion by colleges, universities, and schools of higher education
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The executive law is amended by adding a new section 719 to
2 read as follows:
3 § 719. Mandatory filing of certificate of security information. 1.
4 Prior to receipt of any financial assistance from the state of New York
5 or any of its political subdivisions, any college, university or other
6 institute or school of higher education or vocational learning shall
7 file with the office of the attorney general, a notification form, veri-
8 fied by the president or highest designated official of such college,
9 university, or other institute or school of higher education or voca-
10 tional learning, affirming that such college, university or other insti-
11 tute or school of higher education or vocational learning has filed a
12 certificate of security information with the federal bureau of investi-
13 gation, the federal department of homeland security, and the division of
14 the New York state police. The filing of such verified notification form
15 shall include a copy of the certificate of security information so
16 filed.
17 2. Prior to receipt of any financial assistance from the state of New
18 York or any of its political subdivisions, any college, university or
19 other institute or school of higher education or vocational learning
20 shall file with the federal bureau of investigation, the federal depart-
21 ment of homeland security, and the division of the New York state
22 police, a certificate of security information, verified by the president
23 or highest designated official of such college, university, or other

1 institute or school of higher education or vocational learning, which
2 provides the name; current street address; current email address;
3 current telephone number; nation of origin; all courses enrolled in
4 and/or registered for; and the social security number or taxpayer ID
5 number or federal immigration documentation information, for every
6 student registered, attending or auditing such college, university, or
7 other institute or school of higher education or vocational learning who
8 is not a citizen of the United States. Such certificate shall be filed
9 with the federal bureau of investigation, the federal department of
10 homeland security, and the division of the New York state police prior
11 to the commencement of each academic semester, or provision of educa-
12 tional services.
13 3. Any college, university or other institute or school of higher
14 education or vocational learning that fails to file the notification of
15 filing and certificate of security information prior to the commencement
16 of the academic semester or provision of educational services, as
17 provided by subdivisions one and two of this section, and that has
18 received any financial assistance from the state of New York or any of
19 its political subdivisions, shall be liable for a civil penalty of up to
20 three times the amount of the financial assistance so received.
21 4. For the purpose of this section, the term "college, university, or
22 other institute or school of higher education or vocational learning"
23 shall include:
24 a. any public or private college or university;
25 b. any professional, technical, or vocational school, academy or
26 institute; or
27 c. any other school, academy, institute, or program, upon the conclu-
28 sion of which the student shall be awarded a diploma, certificate,
29 license, permit, or registration.
30 § 2. This act shall take effect immediately.
