        Introduced  by  Sen.  ORTT  --  read twice and ordered printed, and when
          printed to be committed to the Committee on Mental Health and Develop-
          mental Disabilities
 
        AN ACT to amend the mental hygiene law, in relation to clinical  records
          and confidentiality
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Paragraph 4 of subdivision (c)  of  section  33.13  of  the
     2  mental  hygiene  law,  as amended by chapter 184 of the laws of 1986, is
     3  amended to read as follows:
     4    4. to the [commission on quality of care for the mentally disabled and
     5  any person or agency under contract with the commission  which  provides
     6  protection  and  advocacy  services pursuant to the authorization of the
     7  commission to administer the protection and advocacy system as  provided
     8  for  by  federal  law]  justice center for the protection of people with
     9  special needs.
    10    § 2. Subdivision (c) of section 33.13 of the  mental  hygiene  law  is
    11  amended by adding a new paragraph 17 to read as follows:
    12    17.  to  the agency designated by the governor pursuant to subdivision
    13  (b) of section 558 of the executive law to provide protection and  advo-
    14  cacy  services  and  administer  the  protection  and advocacy system as
    15  provided for by federal law.
    16    § 3. This act shall take effect immediately.
