        Introduced by Sens. LITTLE, MARCHIONE -- read twice and ordered printed,

          mitted to the Committee on Crime  Victims,  Crime  and  Correction  in
          accordance  with Senate Rule 6, sec. 8 -- reported favorably from said
          committee, ordered to first and second  report,  ordered  to  a  third
          reading,  amended  and  ordered  reprinted, retaining its place in the
          order of third reading
 
        AN ACT to amend the correction law, in relation to authorizing the Wash-
          ington county correctional facility to also be used for the  detention
          of  persons  under  arrest  being  held  for  arraignment in any court
          located in the county of Washington and authorizing the  Essex  county
          correctional  facility  to  also  be used for the detention of persons
          under arrest being held for arraignment in any court  located  in  the
          county of Essex
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 500-a of the correction law is  amended  by  adding
     2  two new subdivisions 2-o and 2-p to read as follows:
     3    2-o.  The Washington county correctional facility may also be used for
     4  the detention of persons under arrest being held for arraignment in  any
     5  court located in the county of Washington.
     6    2-p.  The  Essex county correctional facility may also be used for the
     7  detention of persons under arrest being  held  for  arraignment  in  any
     8  court located in the county of Essex.
     9    §  2. Section 500-c of the correction law is amended by adding two new
    10  subdivisions 21 and 22 to read as follows:
    11    21. Notwithstanding any other provision of law, in the county of Wash-
    12  ington all the provisions of this section shall  equally  apply  in  any
    13  case  where the sheriff is holding a person under arrest for arraignment
    14  prior to commitment, as if such person had been judicially committed  to

     1  the custody of the sheriff and such person may be held in the Washington
     2  county correctional facility.
     3    22. Notwithstanding any other provision of law, in the county of Essex
     4  all the provisions of this section shall equally apply in any case where
     5  the  sheriff  is  holding a person under arrest for arraignment prior to
     6  commitment, as if such person  had  been  judicially  committed  to  the
     7  custody  of  the sheriff and such person may be held in the Essex county
     8  correctional facility.
     9    § 3. This act shall take effect immediately;  provided  further,  that
    10  the  amendments  to  section 500-c of the correction law made by section
    11  two of this act shall not affect the repeal of such section and shall be
    12  deemed repealed therewith.
