Exempts active duty military personnel, both New York militia and members of the United States military, from taking required hunting courses for purposes of obtaining a hunting license.

AN ACT to amend the environmental conservation law, in relation to
exempting active duty military personnel from taking required hunting
courses for purposes of obtaining a hunting license
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subparagraph 3 of paragraph a of subdivision 3 of section
2 11-0713 of the environmental conservation law, as amended by section 27
3 of part F of chapter 82 of the laws of 2002, is amended and a new
4 subparagraph 4 is added to read as follows:
5 (3) a certificate of qualification in responsible hunting, responsible
6 bowhunting and responsible trapping practices, including safety, ethics
7 and landowner-hunter relations, issued or honored by the department,
8 pursuant to this subdivision[.]; or
9 (4) proof of membership in the military forces and engaged in full-
10 time active military duty or active military service of the United
11 States by a resident of the state. For purposes of this paragraph:
12 (A) "active military duty" shall mean military duty in or with a force
13 of the organized militia (not including the inactive national guard and
14 not including the New York guard when in an inactive status) or in the
15 division of military and naval affairs of the executive department of
16 the state; and
17 (B) "active military service of the United States" shall mean full-
18 time duty in the army, navy (including marine corps), air force or coast
19 guard of the United States.
20 § 2. This act shall take effect immediately.
