AN ACT to amend the public health law, in relation to directing the
commissioner of health to cause the distribution of crib safety infor-
mation to maternity patients
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivision 1 of section 206 of the public health law is
2 amended by adding a new paragraph (v) to read as follows:
3 (v) by rule and regulation, cause the distribution of crib safety
4 information. (1) The commissioner shall require that every hospital and
5 birth center distribute at the time of discharge directly to each mater-
6 nity patient and, upon request, to the general public an informational
7 leaflet concerning crib safety. Such leaflet shall be designed by the
8 commissioner in conjunction with the director of the division of consum-
9 er protection, on behalf of the consumer protection division, and shall
10 contain information detailing safe sleeping procedures for babies, crib
11 product recalls and disclosure of the federal standards on the manufac-
12 ture and sale of cribs.
13 (2) Such leaflet shall be made available to hospitals and birth
14 centers by the department on its website and shall be provided in
15 English, as well as the top six languages other than English spoken in
16 the state according to the latest available data from the United States
17 Bureau of Census.
18 (3) Hospital staff shall inquire whether the maternity patient has a
19 new crib available for any newborns. If the maternity patients do not
20 have a new crib available, hospital staff shall provide information
21 about where to obtain a new crib, including social services agencies,
22 non-profit service providers or other relevant organizations.
23 § 2. This act shall take effect on the first of May next succeeding
24 the date upon which it shall have become a law. Effective immediately,
25 the addition, amendment and/or repeal of any rule or regulation neces-
26 sary for the implementation of this act on its effective date is author-
27 ized to be made on or before such date.
