Provides for issuance of annual permits authorizing on-premises consumption licensees to be open between 10:00 AM and noon on Sunday, and special permits to be open between 8:00 AM and noon on Sunday.

AN ACT to amend the alcoholic beverage control law, in relation to
authorizing the sale of alcoholic beverages for on-premises consump-
tion on Sunday mornings
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Paragraph (a) of subdivision 5 of section 106 of the alco-
2 holic beverage control law, as amended by chapter 83 of the laws of
3 1995, is amended to read as follows:
4 (a) Sunday, from four ante meridiem to twelve noon, except as author-
5 ized pursuant to section ninety-nine-h of this chapter or by special
6 permit.
7 § 2. The alcoholic beverage control law is amended by adding a new
8 section 99-h to read as follows:
9 § 99-h. Annual permit to remain open during certain hours of the morn-
10 ing. 1. Any person licensed to sell alcoholic beverages for consumption
11 on the premises pursuant to this chapter or any applicant for an
12 original license to sell alcoholic beverages for consumption on the
13 premises pursuant to this chapter may apply to the liquor authority for
14 an annual permit to remain open on Sunday between the hours of ten
15 o'clock a.m. and twelve noon. Any applicant for such an annual permit
16 shall provide notice to the local municipality of such application as
17 provided in section one hundred ten-b of this chapter.
18 2. The annual fee for such annual permit shall be two hundred fifty
19 dollars in the counties of New York, Kings, Bronx and Queens; one
20 hundred fifty dollars in the county of Richmond and in cities having a
21 population of more than one hundred thousand and less than one million;
22 one hundred dollars in cities having a population of more than fifty
23 thousand and less than one hundred thousand; and two hundred fifty
24 dollars elsewhere.

1 3. Such annual permit and the exercise of the privileges granted ther-
2 eunder shall be subject to such rules as the liquor authority may deem
3 necessary.
4 § 3. Subdivision 3 of section 99 of the alcoholic beverage control law
5 is renumbered subdivision 4 and a new subdivision 3 is added to read as
6 follows:
7 3. Any person licensed to sell alcoholic beverages for consumption on
8 the premises pursuant to this chapter may apply to the liquor authority
9 for a special permit to open on any Sunday between the hours of eight
10 a.m. and twelve noon. Unless otherwise approved by the authority pursu-
11 ant to subdivision nine of section seventeen of this chapter, where any
12 rule has been adopted in a county further restricting the hours of sale
13 for alcoholic beverages, such restricted hours shall be the hours,
14 during which the sale of alcoholic beverages at retail for on-premises
15 consumption shall not be permitted within such county. No more than
16 twelve special permits issued pursuant to this subdivision may be issued
17 to the same licensed person in any calendar year. The fee for such
18 permit shall be at the rate of fifty-one dollars per day.
19 § 4. This act shall take effect on the thirtieth day after it shall
20 have become a law.
