AN ACT providing that a student enrolled in an individualized education
plan during certain school years may continue to receive educational
services until the student completes the services pursuant to the
individualized education plan or turns twenty-three years of age,
whichever is sooner; and to provide for the repeal of such provisions
upon the expiration thereof
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Notwithstanding any provision of law, rule or regulation to
2 the contrary, a school district may provide educational services in the
3 2021-22 and 2022-23 school years to a student who turned twenty-one
4 years old during the 2019-20 or 2020-21 school years and was enrolled in
5 the school district and receiving special education services pursuant to
6 an individualized education plan. Such student may continue to receive
7 such educational services until the student completes the services
8 pursuant to the individualized education plan or turns twenty-three
9 years of age, whichever is sooner.
10 § 2. This act shall take effect immediately and shall expire and be
11 deemed repealed June 30, 2023.
