Relates to duties of the office of parks, recreation and historic preservation; states that the office shall have no duty to guard, warn, supervise or otherwise keep safe for swimming, diving, bathing or wading by the public those areas of waterbodies which are not expressly designated by the office for such purposes or are used by the public outside the hours and seasonal times as authorized by the office.

AN ACT to amend the parks, recreation and historic preservation law, in
relation to the duties of the office
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 3.09 of the parks, recreation and historic preser-
2 vation law is amended by adding a new subdivision 23 to read as follows:
3 § 23. Notwithstanding any provision of law, rule or regulation to the
4 contrary, have no duty to guard, warn, supervise or otherwise keep safe
5 for swimming, diving, bathing or wading by the public those areas of
6 waterbodies which are not expressly designated by the office for such
7 purposes or which are designated for swimming, diving, bathing or
8 wading, but which are used by the public for such purposes outside the
9 hours and seasonal times as expressly authorized by the office.
10 § 2. This act shall take effect immediately.
