        Introduced  by Sen. GRIFFO -- (at request of the New York Power Authori-
          ty) -- read twice and ordered printed, and when printed to be  commit-
          ted  to  the  Committee  on Energy and Telecommunications -- committee
          discharged, bill amended, ordered reprinted as amended and recommitted
          to said committee
 
        AN ACT to amend the public authorities law, relating  to  energy-related
          projects, programs and services of the power authority of the state of
          New York
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Paragraph a of subdivision 17 of section 1005 of the public
     2  authorities law, as amended by chapter 494  of  the  laws  of  2011,  is
     3  amended to read as follows:
     4    (a)  As  deemed  feasible  and  advisable  by the trustees, to finance
     5  [and], design, develop, construct,  implement,  provide  and  administer
     6  energy-related  projects,  programs  and services for any public entity,
     7  any independent not-for-profit institution of  higher  education  within
     8  the state, and any recipient of [the] economic development power, expan-
     9  sion  power,  replacement  power,  preservation  power, high load factor
    10  power, municipal  distribution  agency  power,  [power  for  jobs,  and]
    11  recharge  New York power [programs administered by], or allocated by the
    12  authority, and any party located within the  state  of  New  York  under
    13  contract  with the authority to purchase power from the authority pursu-
    14  ant to this title or any other law. In establishing and  providing  high
    15  performance and sustainable building programs and services authorized by
    16  this  subdivision,  the  authority  is  authorized to consult standards,
    17  guidelines, rating systems, and/or criteria established  or  adopted  by
    18  other  organizations,  including  but  not  limited to the United States
    19  green building council under its leadership in energy and  environmental
    20  design  (LEED)  programs,  the  green building initiative's green globes
    21  rating system, and the American National Standards Institute. The source
    22  of any financing and/or loans provided by the authority for the purposes
    23  of this subdivision may be the proceeds  of  notes  issued  pursuant  to
    24  section  one thousand nine-a of this title, the proceeds of bonds issued

     1  pursuant to section one thousand ten of this title, or any other  avail-
     2  able authority funds.
     3    § 2. Subparagraph 2 of paragraph (b) of subdivision 17 of section 1005
     4  of  the  public  authorities law, as added by chapter 477 of the laws of
     5  2009 and as renumbered by section 16 of part CC of  chapter  60  of  the
     6  laws of 2011, is amended to read as follows:
     7    (2)  "Energy-related  projects,  programs  and  services" means energy
     8  management, distribution, or control projects and services, energy effi-
     9  ciency projects and  services,  clean  energy  technology  projects  and
    10  services,  and  high  performance  and sustainable building programs and
    11  services, and the construction, installation and/or operation of facili-
    12  ties or equipment done in connection with any such projects, programs or
    13  services.
    14    § 3. This act shall take effect immediately.
