AN ACT to amend the environmental conservation law, in relation to chem-
icals in nap mats
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Article 37 of the environmental conservation law is amended
2 by adding a new title 9 to read as follows:

4 CHEMICAL FLAME RETARDANTS IN NAP MATS
5 Section 37-0901. Definitions.
6 37-0903. Prohibition on the use of chemical flame retardants in
7 nap mats.
8 § 37-0901. Definitions.
9 As used in this title:
10 1. "Chemical flame retardants" shall mean any halogenated chemical
11 flame retardant, including but not limited to TDCPP Tris (1,3 dicholo-
12 ro-2-propyl) phosphate, fire-master 500 or equivalent product, tert-bu-
13 tyl mixture, TCPP Tris(1-chloro-2-propyl) phosphate, TPP (triphenyl
14 phosphate), and any phosphorus-bromine flame retardants.
15 2. "Nap mat" shall include any item of furniture intended for indoor
16 use that consists, in whole or in part, of leather, plastic, fabric or
17 other material that contains cotton, wool, polyurethane or other natural
18 or synthetic material that is placed in such item and is intended to
19 facilitate sleep or relaxation of a child.
20 § 37-0903. Prohibition on the use of chemical flame retardants in nap
21 mats.
22 1. No person, firm, partnership, association, limited liability compa-
23 ny or corporation shall sell or offer for sale in the state of New York
24 any nap mat that contains chemical flame retardants intentionally added
25 in order to provide a specific characteristic, appearance or quality, to
26 perform a specific function, or for any other purpose.

1 2. The provisions of this section shall not apply to the sale or
2 distribution of any nap mat resold or offered for resale, or distributed
3 by consumers for consumer use.
4 § 2. This act shall take effect January 1, 2016.
