AN ACT to amend the administrative code of the city of New York, in
relation to an exemption for veterans' service organizations from
certain fees
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 24-255 of the administrative code of the city of
2 New York is amended by adding a new subdivision (c) to read as follows:
3 (c) 1. For purposes of this subdivision "veterans' service organiza-
4 tion" means an association, corporation or other entity that qualifies
5 under section 501(c)(3) or section 501(c)(19) of the Internal Revenue
6 Code as a tax-exempt organization that has been organized for the bene-
7 fit of veterans and recognized or chartered by the United States
8 Congress, including, but not limited to the Disabled American Veterans,
9 the Veterans of Foreign Wars, the American Legion and the Vietnam Veter-
10 ans of America. The term also includes a member or employee of an eligi-
11 ble non-profit veterans' corporation, association or entity, such as the
12 Missing In America Veteran Recovery Program, that specifically assists
13 in facilitating the identification and internment of unclaimed remains
14 of American veterans.
15 2. A veterans' services organization shall be exempt from any fee
16 levied by this section.
17 § 2. Subdivision 6 of section 25-202 of the administrative code of the
18 city of New York, as amended by local law number 46 of the city of New
19 York for the year 2011, is amended to read as follows:
20 6. Exemptions. (a) The provisions of this section shall not apply if a
21 municipal department or agency of the city is the applicant or appellant
22 before the board of standards and appeals.
23 (b) 1. For purposes of this subdivision "veterans' service organiza-
24 tion" means an association, corporation or other entity that qualifies
25 under section 501(c)(3) or section 501(c)(19) of the Internal Revenue
26 Code as a tax-exempt organization that has been organized for the bene-

9 2. The fee for a certificate of occupancy established in subparagraph
10 one of paragraph c of subdivision three of this section shall not apply
11 to veterans' services organizations.
12 § 3. This act shall take effect immediately.
