        Introduced  by  Sen. MARTINS -- read twice and ordered printed, and when
          printed to be committed  to  the  Committee  on  Health  --  committee
          discharged, bill amended, ordered reprinted as amended and recommitted
          to said committee
 
        AN ACT to amend the public health law and the education law, in relation
          to  allowing  pharmacies  to  electronically transfer prescriptions to
          other pharmacies

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 281 of the public health law is amended by adding a
     2  new subdivision 3-a to read as follows:
     3    3-a.  A  pharmacy  that  receives  an electronic prescription from the
     4  person issuing the prescription may, if the prescription  has  not  been
     5  dispensed  and  at  the request of the patient or a person authorized to
     6  make the request on behalf  of  the  patient,  immediately  transfer  or
     7  forward  such  prescription to an alternative pharmacy designated by the
     8  requesting party.
     9    § 2. Section 6810 of the education law is  amended  by  adding  a  new
    10  subdivision 10-a to read as follows:
    11    10-a.  A  pharmacy  that  receives an electronic prescription from the
    12  person issuing the prescription may, if the prescription  has  not  been
    13  dispensed  and  at  the request of the patient or a person authorized to
    14  make the request on behalf  of  the  patient,  immediately  transfer  or
    15  forward  such  prescription to an alternative pharmacy designated by the
    16  requesting party.
    17    § 3. This act shall take effect on the ninetieth day  after  it  shall
    18  have become a law.
