        Introduced  by Sen. FLANAGAN -- read twice and ordered printed, and when
          printed to be committed to the Committee on Rules
 
        AN ACT relating to regional tuition rates for special education  itiner-
          ant services
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 

     1    Section 1. Notwithstanding any inconsistent provision of law, rule  or
     2  regulation  to  the contrary, the New York state department of education
     3  is hereby directed to develop a rate setting methodology for the  calcu-
     4  lation  of  the rates of reimbursement for all classroom based preschool
     5  special education programs approved under section 4410 of the  education
     6  law for the 2014-15 school year where under the actual costs incurred by
     7  such  program  for  such  classroom  operations for the past three years
     8  shall be averaged and such average amount shall be the  base  costs  for
     9  such program for the 2014-15 school year and shall not be subject to any
    10  total  cost screen, parameter or other constraint on the full reimburse-
    11  ment of actual costs incurred.
    12    § 2. This act shall take effect immediately.
