        Introduced  by  Sen. LAVALLE -- read twice and ordered printed, and when
          printed to be committed to the Committee on Investigations and Govern-
          ment Operations
 
        AN ACT to amend the alcoholic beverage control law, in relation  to  the
          definition of a catering establishment
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Subdivision 7-a of section  3  of  the  alcoholic  beverage
     2  control  law, as added by chapter 682 of the laws of 1935, is amended to
     3  read as follows:
     4    7-a. "Catering establishment" means and includes any premises owned or
     5  operated by any person, firm, association,  partnership  or  corporation
     6  who  or  which  regularly  and  in a bona fide manner furnishes for hire
     7  therein one or more ballrooms, reception rooms,  dining  rooms,  banquet
     8  halls,  dancing  halls  or similar places of assemblage for a particular
     9  function, occasion or event and/or who or which furnishes provisions and
    10  service for consumption or use at such function, occasion or event. Such
    11  premises must have suitable and adequate facilities  and  accommodations
    12  to  provide food and service [for not less than fifty persons at any one
    13  function, occasion or event] and shall in no event be deemed to  include
    14  any  taxi  dance  hall  or any other premises at which public dances are
    15  regularly scheduled to be held daily, weekly or monthly and to which the
    16  general public is invited.
    17    § 2. Severability. If any provision of this act, or any application of
    18  any provision of this act, is held to be invalid, that shall not  affect
    19  the  validity or effectiveness of any other provision of this act, or of
    20  any other application of any provision of this act, which can  be  given
    21  effect  without  that  provision  or  application;  and to that end, the
    22  provisions and applications of this act are severable.
    23    § 3. This act shall take effect immediately.
