        Introduced  by  Sen. BONACIC -- read twice and ordered printed, and when
          printed to be committed to the Committee on Rules
 
        AN ACT to amend the town law, in relation to town police departments  in
          any village within the town of Tuxedo
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Subdivision 1 of section 150 of the town law, as amended by
     2  chapter 843 of the laws of 1980, is amended to read as follows:
     3    1. The town board of any town may establish a  police  department  and
     4  appoint  a  chief  of  police  and such officers and patrolmen as may be
     5  needed and fix their compensation. The compensation  of  such  policemen
     6  shall  be a town charge; providing however, no assessment on property in
     7  any village within any town or partially within any town shall  be  made
     8  for the maintenance or operation of a town police department established
     9  after January first, nineteen hundred sixty, pursuant to this section if
    10  any such village maintains a police department of four or more policemen
    11  on an annual full-time basis, established and maintained under the rules
    12  of  civil service. The town board may, at its option, determine that the
    13  town shall pay all or part of the cost of  the  uniforms  and  necessary
    14  equipment  of  its policemen, and may purchase such equipment for use by
    15  the police department as  it  shall  deem  necessary,  including  police
    16  patrol  vehicles,  and  emergency  service  vehicles  for  police use in
    17  connection with accidents, public calamities or  other  emergencies.  No
    18  assessment  on  property in any village within any town in the county of
    19  Suffolk [or], in any village within the town of  Fallsburgh  or  in  any
    20  village  within  the town of Tuxedo shall be made for the maintenance or
    21  operation of such town police department, if any such village  maintains
    22  a  police department of two or more policemen on an annual basis. In the
    23  event that a town has established a police department prior  to  January
    24  first,  nineteen  hundred  sixty,  the town board of such town may enter
    25  into an agreement with any village within  it  or  partially  within  it
    26  which  maintains  a  police  department  of four or more policemen on an
    27  annual full-time basis, established and maintained under  the  rules  of
    28  civil  service and determine therein what part of the cost thereof shall

     1  be assessed against the property in the village and  what  part  thereof
     2  shall  be  assessed  against  the  property  in  the town outside of the
     3  village.  Thereafter such portion of the cost thereof determined  to  be
     4  assessed  outside  of the village shall be a charge against that part of
     5  the town outside of the village and assessed, levied and collected  from
     6  the  taxable  property  of that part of the town outside of the village.
     7  When appointed, such policemen shall be police officers and  shall  have
     8  all  the  powers  and  be subject to all the duties and liabilities of a
     9  police officer in all  criminal  actions  and  proceedings  and  special
    10  proceedings of a criminal nature.
    11    § 2. This act shall take effect immediately.
