        Introduced  by  Sen.  SQUADRON  --  (at request of the Governor) -- read
          twice and ordered printed, and when printed to  be  committed  to  the
          Committee on Energy and Telecommunications
 
        AN  ACT  to amend the energy law, in relation to appliance and equipment
          energy efficiency standards for portable light  fixtures,  bottle-type
          water dispensers, commercial hot food holding cabinets, portable elec-

          tric spas and residential pool pumps
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 16-102 of the energy law is amended by adding seven
     2  new subdivisions 4-a, 6-a, 21-a, 21-b, 27-a, 27-b and 29-a  to  read  as
     3  follows:
     4    4-a. "Bottle-type water dispenser" means a water dispenser that uses a
     5  bottle or reservoir as the source of potable water.
     6    6-a.  "Commercial  hot  food  holding  cabinet"  means a heated, fully
     7  enclosed compartment, with one or more solid  or  partial  glass  doors,
     8  that  is  designed to maintain the temperature of hot food that has been
     9  cooked in a separate appliance. "Commercial hot  food  holding  cabinet"

    10  does  not include heated glass merchandising cabinets, drawer warmers or
    11  cook-and-hold appliances.
    12    21-a. "Lamp" means an  electrical  appliance  that  includes  a  glass
    13  envelope  and produces optical radiation for the purpose of visual illu-
    14  mination, designed to be installed into a light fixture by means  of  an
    15  integral lamp-holder or socket.
    16    21-b.  "Light  fixture" means a product designed to provide light that
    17  includes at least one lamp-holder or socket and parts to distribute  the
    18  light,  to  position  or protect one or more lamps and to connect one or
    19  more lamps to a power supply.
    20    27-a. "Portable electric spa" means a factory-built  electric  spa  or

    21  hot tub, supplied with equipment for heating and circulating water.
    22    27-b. "Portable light fixture" means a light fixture which has a flex-
    23  ible cord and an attachment plug for connection to a nominal one hundred
    24  twenty-volt,  fifteen-  or  twenty-ampere  branch  circuit; which can be
    25  relocated by the user without  any  rewiring;  and  which  is  typically

     1  controlled  with  a switch located on the light fixture itself or on the
     2  power cord. "Portable light fixture" does  not  include  direct  plug-in

     3  nightlights;  sun  and  heat  lamps;  aquarium lamps; medical and dental
     4  lights;  portable  electric hand lamps; signs and commercial advertising
     5  displays;  photographic  lamps;  germicidal  lamps;  metal  halide  lamp
     6  fixtures; torchiere lighting fixtures; portable lamp fixtures for marine
     7  use  or  for use in hazardous locations as defined in the national elec-
     8  trical code, ANSI/NFPA 70; or decorative lighting  outfits  or  electric
     9  candles and candelabras without lampshades that are covered by the stan-
    10  dard for safety of seasonal and holiday decorative products, UL 588.
    11    29-a.  "Residential  pool  pump"  means a product which is designed or
    12  used to circulate and filter residential swimming pool water in order to

    13  maintain clarity and sanitation and which consists in part  of  a  motor
    14  and an impeller.
    15    §  2.  Subdivision  1 of section 16-104 of the energy law, as added by
    16  chapter 431 of the laws of 2005, is amended to read as follows:
    17    1. The provisions of this article apply to the testing,  certification
    18  and  enforcement  of efficiency standards for the following new products
    19  which are sold, offered for sale or installed in  New  York  state:  (a)
    20  automatic  commercial ice cube machines; (b) ceiling fan light kits; (c)
    21  commercial pre-rinse spray valves; (d) commercial refrigerators,  freez-
    22  ers  and  refrigerator-freezers;  (e) consumer audio and video products;
    23  (f) illuminated exit signs; (g) incandescent reflector lamps;  (h)  very
    24  large  commercial  packaged  air-conditioning and heating equipment; (i)

    25  metal halide lamp fixtures; (j) pedestrian traffic signal  modules;  (k)
    26  power  supplies; (l) torchiere lighting fixtures; (m) unit heaters [and]
    27  (n) vehicular traffic signal modules; (o) portable light  fixtures;  (p)
    28  bottle-type  water dispensers; (q) commercial hot food holding cabinets;
    29  (r) portable electric spas; and (s) residential pool pumps.
    30    § 3. Subdivision 2 of section 16-106 of the energy law is  amended  by
    31  adding a new paragraph (c) to read as follows:
    32    (c)  On  or before December thirty-first, two thousand ten, the secre-
    33  tary, in consultation with the president,  shall  adopt  regulations  in
    34  accordance  with the provisions of this article establishing: (i) energy
    35  efficiency performance standards for new products of the types set forth

    36  in paragraphs (o) through (s) of subdivision one of  section  16-104  of
    37  this  article;  (ii) procedures for testing the energy efficiency of the
    38  products covered by paragraphs (o) through (s)  of  subdivision  one  of
    39  section  16-104  of  this article; (iii) procedures for manufacturers to
    40  certify that products covered by paragraphs (o) through (s) of  subdivi-
    41  sion  one  of  section 16-104 of this article meet the energy efficiency
    42  standards promulgated under this article; and (iv) such further  matters
    43  as  are necessary to insure the proper implementation and enforcement of
    44  the provisions of this article with respect to the products  covered  by
    45  paragraphs  (o) through (s) of subdivision one of section 16-104 of this
    46  article.

    47    § 4. This act shall take effect immediately.
