        Introduced  by Sen. HARCKHAM -- read twice and ordered printed, and when
          printed to be committed to the Committee on Education
 
        AN ACT to amend the education law, in relation to  the  repayment  by  a
          school  district  of a penalty arising from the late filing of a final
          cost report for an approved capital construction project
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  The education law is amended by adding a new section 3615
     2  to read as follows:
     3    § 3615. Penalty  repayment;  late  filing  of  a  final  cost  report.
     4  Notwithstanding  any  other provision of law, the period of time for the
     5  recovery by the commissioner from a school district of any penalty aris-
     6  ing from the late filing of a final cost report for an approved  capital
     7  construction  project of such school district shall not be less than ten
     8  years.
     9    § 2. This act shall take effect immediately.
