Go to top STATE OF NEW YORK ________________________________________________________________________ 8113 IN SENATE March 29, 2018 ___________ Introduced by Sen. LANZA -- (at request of the Office of Court Adminis- tration) -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the penal law, in relation to calculation of consecutive definite sentences The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Paragraph (b) of subdivision 2 of section 70.30 of the 2 penal law is amended to read as follows: 3 (b) If the sentences run consecutively and are to be served in a 4 single institution, the terms are added to arrive at an aggregate term 5 and are satisfied by discharge of such aggregate term, or by service of 6 an aggregate term of two years imprisonment plus any term imposed for an 7 offense committed while the person is under the sentences, whichever is 8 less; 9 § 2. This act shall take effect immediately. EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD14499-01-8
