AN ACT creating the radon task force; and providing for the repeal of
such provisions upon expiration thereof
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Legislative intent. The legislature recognizes the dangers
2 to human health which exposure to radon causes. Radon is a naturally
3 occurring, odorless radioactive gas that is one of the leading causes of
4 lung cancer. The New York state department of health has identified over
5 twenty-five counties as "high risk counties" for exposure to radon. It
6 is critically important for New York state to develop a comprehensive
7 approach to protecting New York residents from this potential health
8 hazard.
9 § 2. There is hereby created the "radon task force" to conduct a
10 comprehensive study on the prevention of human exposure to radon and
11 make recommendations to reduce and minimize exposure to New York state
12 residents. The scope of such study shall include:
13 1. Examine the need for interagency coordination of public education
14 and outreach and prevention programs;
15 2. Examine the need for training, education and possible licensing of
16 radon services providers; and
17 3. Review of any other related information that the commissioner of
18 health may deem necessary or relevant in carrying out such study of
19 radon in indoor settings.
20 § 3. 1. The task force shall consist of seven members as follows:
21 a. the secretary of state or the secretary's designee;
22 b. the commissioner of health or such commissioner's designee;
23 c. the commissioner of labor or such commissioner's designee;
24 d. two members to be appointed by the governor, one of whom shall be
25 an individual who possesses expertise in the field of radon testing and

1 mitigation and the other being an individual who represents the field of
2 real estate;
3 e. one member to be appointed by the temporary president of the
4 senate; and
5 f. one member to be appointed by the speaker of the assembly.
6 2. The governor shall designate one member to serve as the chairperson
7 of the task force.
8 § 4. Members of the task force shall receive no compensation but shall
9 be reimbursed for their actual and necessary expenses in the performance
10 of their duties pursuant to this act.
11 § 5. A report of the findings and recommendations of the task force
12 and any proposed legislation necessary to implement such findings shall
13 be filed with the governor, the temporary president of the senate, the
14 speaker of the assembly, the minority leader of the senate, and the
15 minority leader of the assembly on or before April first, two thousand
16 nineteen.
17 § 6. This act shall take effect immediately and shall expire and be
18 deemed repealed May 1, 2019.
