        Introduced  by  Sen.  COONEY -- read twice and ordered printed, and when
          printed to be committed to the Committee on Investigations and Govern-
          ment Operations
 
        AN ACT to amend the cannabis law, in relation to  cannabinoid  hemp  and
          hemp extract
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Section 103 of the cannabis law is amended  by  adding  two
     2  new subdivisions 4 and 5 to read as follows:
     3    4.  Notwithstanding  any  law, rule, or regulation, an orally consumed
     4  product in the form of a beverage and  containing  cannabinoids  derived
     5  only from hemp, including cannabinoid hemp or hemp extract:
     6    (a)  may contain up to five milligrams of total delta-9 tetrahydrocan-
     7  nabinol concentration (THC) per container;
     8    (b) may contain, subject to the five milligram of total THC  container
     9  limit  in  paragraph  (a)  of this subdivision, up to five milligrams of
    10  total THC per serving; and
    11    (c) is not required to contain a ratio  of  any  non-THC  cannabinoid,
    12  including  but  not  limited to cannabidiol (CBD), to THC per serving or
    13  container.
    14    5. Notwithstanding any law, rule, or regulation, any  orally  consumed
    15  product  in  the  form of a beverage and containing cannabinoids derived
    16  only from hemp, including cannabinoid hemp  or  hemp  extract,  with  .5
    17  milligrams  or  greater  of  total  THC per container may not be sold to
    18  individuals under twenty-one years of age.
    19    § 2. Section 104 of the cannabis law is amended by adding a new subdi-
    20  vision 5 to read as follows:
    21    5. Notwithstanding any law, rule, or regulation,  an  orally  consumed
    22  product  in  the  form of a beverage and containing cannabinoids derived
    23  only from hemp, including cannabinoid hemp or hemp extract:
    24    (a) may contain up to five milligrams of total delta-9  tetrahydrocan-
    25  nabinol concentration (THC) per container;
 
         EXPLANATION--Matter in italics (underscored) is new; matter in brackets
                              [ ] is old law to be omitted.

     1    (b)  may contain, subject to the five milligram of total THC container
     2  limit in paragraph (a) of this subdivision, up  to  five  milligrams  of
     3  total THC per serving; and

     5  including but not limited to cannabidiol (CBD), to THC  per  serving  or
     6  container.
     7    § 3. This act shall take effect immediately.
