        Introduced  by  Sen.  CHU  --  read  twice and ordered printed, and when
          printed to be committed to the Committee on Social Services
 
        AN ACT to amend the social services law, in relation  to  the  study  of
          supplemental nutrition assistance program (SNAP) benefit fraud
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Section 95 of the social services law is amended by  adding
     2  a new subdivision 12 to read as follows:
     3    12.  (a) No later than two hundred forty days after the effective date
     4  of this subdivision, the commissioner  shall  conduct  a  study  on  the
     5  prevalence  of  supplemental nutrition assistance program (SNAP) benefit
     6  fraud. Such study shall include, but not be limited to:
     7    (i) a detailed evaluation of the  prevalence  of  stolen  supplemental
     8  nutrition assistance program (SNAP) benefits;
     9    (ii)  an  examination  of current barriers, feasibility, and impact on
    10  participant access and ease of use in  developing  and  implementing  an
    11  electronic  benefit  transfer  system using industry-standard commercial
    12  electronic funds transfer technology, including, at a minimum,  the  use
    13  of EMV computer chip cards; and
    14    (iii)  analysis  of  such  other information as the commissioner deems
    15  appropriate.
    16    (b) Upon the completion of the study required  pursuant  to  paragraph
    17  (a)  of this subdivision, the commissioner shall submit to the governor,
    18  the temporary president of the senate, and the speaker of the assembly a
    19  report containing the findings of such study.
    20    (c) No later than one hundred twenty days after the end of each fiscal
    21  year that begins after the submission of the report required pursuant to
    22  paragraph (b) of this subdivision, the commissioner shall submit to  the
    23  governor,  the temporary president of the senate, and the speaker of the
    24  assembly an updated report, which shall include, but not be limited to:
    25    (i) periodic  review  and  modification  of  regulations  relating  to
    26  supplemental nutrition assistance program (SNAP) benefit transfers which
    27  takes into account evolving technology; and

     1    (ii)  analysis  of  the  threat  of  supplemental nutrition assistance
     2  program (SNAP) benefit  fraud  and  means  of  protecting  against  such
     3  threat.
     4    § 2. This act shall take effect immediately.
