  TITLE OF BILL: An act to amend the election law, in relation to prohibiting boards of elections from entering into certain contracts with entities that have made any political campaign donations of any amount in the last ten years   PURPOSE: This bill will protect the integrity of the voting and electoral process by prohibiting the state board of elections from contracting with enti- ties that have political ties.   SUMMARY OF PROVISIONS: Section one amends the election law by adding a new subdivision to prohibit the state board of elections from contracting with entities that have made political contributions of any amount in the past 10 years for the purposes of designing, managing, and processing ballots, affidavits, petitions and any items associated with the voting and election ballot process. Section two establishes an immediate effective date. JUSTIFICATION: In 2020,a Rochester-based commercial printing company with political inter- ests delivered invalid mail-in ballots to voters in the borough of Brooklyn in New York City. As a result, a great number of voters were at risk of being ineligible to vote. It further has been found that the firm in question has consistently made political donations to one of the two major political parties. Effort must be made to preserve the integ- rity of our electoral process by prohibiting contractors with political interests from managing voter registration material and election ballots.   LEGISLATIVE HISTORY: A.9900/S.3798 of 2021-22; A.1558/S.1624 of 2023-24   FISCAL IMPLICATIONS: TBD   EFFECTIVE DATE: Immediately

        AN ACT to amend the election law, in relation to prohibiting  boards  of
          elections from entering into certain contracts with entities that have
          made  any  political  campaign donations of any amount in the last ten
          years

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Section  3-100 of the election law is amended by adding a
     2  new subdivision 4-a to read as follows:
     3    4-a. Except where expressly permitted  by  law,  the  state  board  of
     4  elections  shall  not  enter  into  any  contract  or agreement with any
     5  person, firm, corporation, or other entity, that has made any  political
     6  campaign donations of any amount in the last ten years, for the prepara-
     7  tion,  design, printing, mailing, distribution, delivery, processing, or
     8  counting of  ballots,  affidavits,  petitions,  applications,  or  other
     9  papers  and  materials  involved  in  the  conduct  of elections and the
    10  canvass of results under this chapter.
    11    § 2. This act shall take effect immediately.
