NEW YORK STATE ASSEMBLY MEMORANDUM IN SUPPORT OF LEGISLATION submitted in accordance with Assembly Rule III, Sec 1(f)

BILL NUMBER: A6913
SPONSOR: Zaccaro

TITLE OF BILL:
An act to amend the general business law, in relation to domestic
violence and sexual assault awareness education for licensed cosmetolo-
gists

PURPOSE OR GENERAL IDEA OF BILL:
This bill would require all licensees and applicants for a license or
renewal of cosmetology to take an awareness course pertaining to domes-
tic violence and sexual assault.

SUMMARY OF PROVISIONS:
Section 1. § 408-b of the general business law is amended to require an
educational awareness course on domestic violence and sexual assault for
all licensees' applicants for a license or renewal of cosmetology. In
addition, it requires the Office for the Prevention of Domestic Violence
to develop educational materials on domestic violence for cosmetology
professionals. The materials will cover topics such as definitions,
signs, and symptoms of domestic violence, response strategies, local
resources, and confidentiality. A comprehensive course will be required
for licensure, and the Office will ensure its availability and
completion by all licensees. Lastly, the Office and Secretary of State
will monitor compliance and take enforcement action as necessary.
Section 2. Effective date.

JUSTIFICATION:
By educating cosmetology professionals on the signs of domestic violence
and sexual assault, this bill enables early intervention which is crit-
ical in preventing further abuse. Cosmetology professionals, such as
hairstylists and nail technicians, often develop close relationships
with their clients, making them uniquely positioned to identify signs of
domestic violence. By training them to recognize and respond to victims,
we will create a network of supportive professionals who can provide
guidance, resources, and a safe space for victims to share their experi-
ences.
Salons and spas can serve as safe spaces for victims of domestic
violence, providing a temporary reprieve from their abusive environment.
By training professionals to recognize and respond to victims, this bill
ensures these spaces remain safe and supportive. Moreover, it encourages
community engagement and collaboration between cosmetology profes-
sionals, domestic violence advocacy groups, and law enforcement agen-
cies. By fostering these relationships, this can build a stronger
support network for victims of domestic violence.

PRIOR LEGISLATIVE HISTORY:
This is a new bill.

FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS:

EFFECTIVE DATE:
This law shall take effect on the one hundred eightieth day after it
shall become law.
