  TITLE OF BILL: An act to amend the cannabis law, in relation to limiting prohibitions of advertising of cannabis products or services on billboards   PURPOSE OR GENERAL IDEA OF BILL: The purpose of this bill is to authorize limited advertisement of canna- bis retail establishments on billboards.   SUMMARY OF PROVISIONS: Section 1 amends paragraph (k) of subdivision 2 of section 86 of the cannabis law to authorize limited adult-use cannabis billboard advertis- ing. Section 2 provides for an immediate effective date.   JUSTIFICATION: Current law prohibits any adult-use cannabis billboard advertisements. This prohibition has proven to hinder licensed retail establishments from adequately advertising their business name, location, hours, and other identifying information. It is appropriate to amend the law to allow retail cannabis establishments to use billboard advertising as long as the billboard: is not false, deceptive, or misleading; promotes overconsumption; depicts consumption; is designed in any way to appeal to children or other minors; makes medical claims or promotes adult-use cannabis for a medical or wellness purpose; appeals to persons less then twenty-one years of age and/or populations at-risk of increased adverse health consequences as determined by the board in regulation; dissem- inate false or misleading information to customers; or includes any cannabis brand information. Allowing adult-use cannabis retail estab- lishments to use billboard advertising to promote their business name, location, hours, and other such information will help licensees succeed and grow the legal marketplace. It is important to note that this bill does not authorize billboard advertising where billboards are otherwise restricted or prohibited by local, state, or federal laws, rules, and regulations.   PRIOR LEGISLATIVE HISTORY: This is a new bill.   FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: None.   EFFECTIVE DATE: Immediately.

        AN ACT to amend the cannabis law, in relation to  limiting  prohibitions
          of advertising of cannabis products or services on billboards
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Paragraph (k) of subdivision 2 of section 86 of the  canna-
     2  bis law is amended to read as follows:
     3    (k)  is  in  the  form  of a billboard that violates the provisions of
     4  paragraph (a), (b), (c), (d) or (i) of this subdivision or paragraph (a)
     5  or (b) of subdivision three of this section or that includes any  canna-
     6  bis brand information; or
