MEMORANDUM IN SUPPORT OF LEGISLATION

  TITLE OF BILL: An act to amend the alcoholic beverage control law, in relation to an exemption for certain property from the prohibition of alcohol sales within a certain distance from a place of worship   PURPOSE OR GENERAL IDEA OF BILL: To authorize the New York State Liquor Authority to issue an on-premise liquor license to Belo, a restaurant in Sunnyside, Queens.   SUMMARY OF PROVISIONS: Section one of the bill amends subdivision 7 of section 64 of the alco- holic beverage control law by adding a new paragraph (e-17), which provides an exemption from the two-hundred-foot rule to,the parcel described. Section two of the bill sets the effective date.   JUSTIFICATION: Section 64 of New York State's Alcoholic Beverage Control law generally prohibits retail licenses for on-premises consumption within 200 feet of a place of worship, but also provides multiple exemptions to this rule. This legislation would allow Belo, a restaurant in Sunnyside, Queens, to apply for an on-premise liquor license from the New York State Liquor Authority. In this case, the place of worship located within 200 feet of Belo recognizes the restaurant as a valued member of its neighborhood and supports its application for a liquor license.   PRIOR LEGISLATIVE HISTORY: New bill.   FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: None.   EFFECTIVE DATE: This act shall take effect immediately.
