        Introduced  by  Sen.  ASHBY  -- read twice and ordered printed, and when
          printed to be committed to the Committee on Crime Victims,  Crime  and

        AN  ACT to amend the correction law, in relation to addiction counseling
          services for incarcerated individuals
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  The correction law is amended by adding a new section 628
     2  to read as follows:
     3    § 628. Addiction counseling program. The commissioner, in  conjunction
     4  with  the  office  of addiction services and supports, shall establish a
     5  program to be administered at correctional facilities within the depart-
     6  ment in the state, for the  purpose  of  offering  addiction  counseling
     7  services  for  any  incarcerated individual in such facilities suffering
     8  from a substance use disorder.  After a medical screening,  incarcerated
     9  individuals  who  are determined to suffer from a substance use disorder
    10  shall be offered placement in an addiction counseling program. Placement
    11  in such program shall not be mandatory.  Each participating incarcerated
    12  individual shall work with an  authorized  specialist  to  determine  an
    13  individualized  treatment  plan, including an appropriate level of coun-
    14  seling.
    15    § 2. Section 45 of the correction law  is  amended  by  adding  a  new
    16  subdivision 20 to read as follows:
    17    20.  Establish  standards  and  guidelines  for a program of addiction
    18  counseling services for incarcerated individuals in county jails  and/or
    19  county  correctional facilities equivalent to the program established in
    20  state correctional facilities pursuant to section  six  hundred  twenty-
    21  eight of this chapter.
    22    § 3. This act shall take effect immediately.
