  TITLE OF BILL: An act to amend the racing, pari-mutuel wagering and breeding law, in relation to using artificial intelligence to personalize advertisements on mobile sports wagering   PURPOSE: Prohibits licensees from relying on artificial intelligence for tracking and advertising purposes   SUMMARY OF SPECIFIC PROVISIONS: Subdivision 4 of section 1367-a of the racing, pari-mutuel wagering and breeding law is amended by adding a new paragraph (k) to read as follows:   (K) MOBILE SPORTS WAGERING LICENSEES SHALL BE PROHIBITED FROM USING ARTIFICIAL INTELLIGENCE TO TRACK A BETTOR'S GAMBLING HABITS AND CREATING INDIVIDUALIZED PROMOTIONS WITH ARTIFICIAL INTELLIGENCE BASED ON SUCH BETTOR'S GAMBLING HABITS.   JUSTIFICATION: Timothy Fong, co-director of the UCLA Gambling Studies Program, believes that advancements in AI have the potential to be weaponized by mobile sports betting platforms. Last year, he said "the use of AI can create predatory scenarios, where people who are already vulnerable because of mental health issues or a gambling addiction could be manipulated or targeted without their knowledge."1 To prevent mobile sports betting platforms from using AI to personalize the betting experience for users by learning their gaming habits, this legislation will ban all mobile sports betting platforms from using AI for the purpose of advertisements, tracking a user's activity, and offering personalized incentives.   LEGISLATIVE HISTORY: New Legislation   FISCAL IMPLICATIONS: TBD   EFFECTIVE DATE: This act shall take effect immediately (1)https://www,tucsonsentinel.com/sports/ report/120324_ai_gambling/door-opens-potential- predatorybehavior-as- sportsbooks-imptement-ai/

        AN ACT to amend the racing, pari-mutuel wagering and  breeding  law,  in
          relation  to  using  artificial intelligence to personalize advertise-
          ments on mobile sports wagering

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1. Subdivision 4 of section 1367-a of the racing, pari-mutuel
     2  wagering and breeding law is amended by adding a new  paragraph  (k)  to
     3  read as follows:
     4    (k)  Mobile  sports  wagering licensees shall be prohibited from using
     5  artificial intelligence to track a bettor's gambling habits and creating
     6  individualized promotions with artificial  intelligence  based  on  such
     7  bettor's gambling habits.
