TITLE OF BILL:
An act to amend a chapter of the laws of 2024 amending the general
municipal law relating to including lakes in adopt-a-municipal park,
shoreline or roadway programs, as proposed in legislative bills numbers
S. 4636 and A. 4563, in relation to fees for activities undertaken
pursuant to a lake program
 
PURPOSE OR GENERAL IDEA OF BILL:
This chapter amendment makes technical amendments to Chapter 651 of the
Laws of 2024 to clarify that the Department of Environmental Conserva-
tion shall not charge any application fee or any other fee for activity
undertaken pursuant to an adopt-a-lake program.
 
SUMMARY OF PROVISIONS:
Section one amends Subdivision 7 of Section 70-0117 of the Environmental
Conservation Law to clarify that the Department of Environmental Conser-
vation shall not charge any application fee or any other fee for activ-
ity undertaken pursuant to an adopt-a-lake program.
Section two provides the effective date.
 
JUSTIFICATION:
Chapter 651 of the Laws of 2024 authorized municipalities to establish
AdoptA-Municipal Lake programs. Currently, the Department of Environ-
mental Conservation (DEC) is prohibited from charging fees for activ-
ities undertaken pursuant to an Adopt-A-Municipal Park, Shoreline, or
Roadway program. This legislation provides negotiated changes to the
underlying chapter, to clarify that DEC shall likewise be prohibited
from charging fees for any activity undertaken pursuant to an Adopt-A-
Municipal Lake program.

This is a new bill.
 
FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS:
No fiscal impact.
 
EFFECTIVE DATE:
This act shall take effect on the same date and in the same manner as a
chapter of the laws of 2024 amending the general municipal law relating
to including lakes in adopt-a-municipal park, shoreline, or, roadway
programs, as proposed in legislative bill numbers S.4636 and A.4563,
takes effect.
