  TITLE OF BILL: An act to amend the penal law, in relation to enacting "Dillon's law"   PURPOSE OR GENERAL IDEA OF BILL: This bill would create statutory penalties for a person found guilty of a drug-induced homicide.   SUMMARY OF SPECIFIC PROVISIONS: Adding five new sections to the penal law, by creating a tier system in which penalties of a drug-induced homicide will be determined. The sub-section of each provision relates to the "underlying" crime by which the defendant is charged with.   JUSTIFICATION: Across the country, we see trends showing controlled substance use and availability increasing at alarming rates. Further- more, 35 percent of the heroin seized by the Drug Enforcement Adminis- tration was seized in New York State in 2014. Drug overdose is now the leading cause of accidental deaths, even eclipsing car crashes. More than 12 million people in 2010 abused painkillers, according to the Centers for Disease Control and Prevention, and data supports the much- repeated narrative that many newer heroin users got started on pills. This legislation will create the appropriate mechanism to help prosecu- tors convict criminals of causing a drug-induced homicide and it will continue to be another tool for law enforcement to combat this growing issue.   PRIOR LEGISLATIVE HISTORY: None.   FISCAL IMPLICATIONS: None.   EFFECTIVE DATE: This act shall take effect immediately.
