AN ACT to amend the labor law, in relation to requiring minimum wage for
public employees
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subparagraphs (h), (i) and (m) of the opening paragraph of
2 subdivision 5 of section 651 of the labor law, as amended by chapter 391
3 of the laws of 2024, are amended to read as follows:
4 (h) in or for such a religious, educational or charitable institution
5 if such individual is a student, provided that this exception shall not
6 apply to a public educational institution; (i) in or for such a reli-
7 gious, educational or charitable institution if the earning capacity of
8 such individual is impaired by age or by physical or mental deficiency
9 or injury, provided that this exception shall not apply to a public
10 educational institution;
11 (m) by [a] the federal[, state or municipal] government [or political
12 subdivision thereof];
13 § 2. Subdivision 6 of section 651 of the labor law, as amended by
14 chapter 281 of the laws of 2002, is amended to read as follows:
15 6. "Employer" includes any individual, partnership, association,
16 corporation, limited liability company, business trust, legal represen-
17 tative, state or local government, or any organized group of persons
18 acting as employer.
19 § 3. This act shall take effect immediately.
