        AN ACT to amend the labor law, in relation to  benefit  protections  for
          certain state employees
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. This act shall be known and may be cited  as  the  "benefit
     2  maintenance act".
     3    § 2. The labor law is amended by adding a new section 202-m to read as
     4  follows:
     5    §  202-m.  Benefits  protection;  employee  transfer by appointment. A
     6  state employee who is appointed pursuant to section seven of the  public
     7  officers law to a different position in a state agency is entitled to:
     8    1. retain all accrued sick leave credits; and
     9    2. retain or use accrued vacation leave credits.
    10    § 3. This act shall take effect immediately.
