        AN ACT to amend the vehicle and traffic law, in relation to  prohibiting
          the  use of flashing signals to indicate the presence of a photo speed
          violation monitoring system
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1. Section 1113 of the vehicle and traffic law, as amended by
     2  chapter 722 of the laws of 2006, is amended to read as follows:
     3    § 1113. Flashing  signal  indications.   (a)   Whenever   traffic   is
     4  controlled  by  a flashing signal used in a traffic sign or signal, only
     5  the colors red and yellow shall be used, and said signals shall indicate
     6  and apply to drivers of vehicles as follows:
     7    [(a)] 1. Flashing red indications. Unless  to  make  another  movement
     8  permitted by other indications shown at the same time, vehicular traffic
     9  facing a circular red signal or red arrow with rapid intermittent flash-
    10  es  shall  stop  at  a clearly marked stop line, but if none, then shall
    11  stop before entering the crosswalk on the near side of the intersection,
    12  or in the event there is no crosswalk, at the point nearest  the  inter-
    13  secting  roadway  where  the driver has a view of approaching traffic on
    14  the intersecting roadway before entering the intersection and the  right
    15  to  proceed shall be subject to the rules applicable after making a stop
    16  at a stop sign.
    17    [(b)] 2. Flashing  yellow  indications.  Vehicular  traffic  facing  a
    18  circular  yellow  signal or yellow arrow with rapid intermittent flashes
    19  may proceed through the intersection  or  past  such  signal  only  with
    20  caution.
    21    [(c)]  3.  Flashing  red  arrows and flashing yellow arrow indications
    22  have the same meaning  as  the  corresponding  flashing  circular  indi-
    23  cations, except that they apply only to drivers of vehicles intending to
    24  make the movement indicated by the arrow.

     1    [(d)]  (b)  This  section shall not apply at railroad grade crossings.
     2  Conduct of drivers of  vehicles  approaching  railroad  grade  crossings
     3  shall  be  governed  by the rules as set forth in section eleven hundred
     4  seventy of this title.
     5    (c)  Notwithstanding any other provision of law, rule or regulation, a
     6  flashing signal shall not be used to indicate the presence  of  a  photo
     7  speed  violation  monitoring  system  authorized under article thirty of
     8  this title, that is located in  a  residential  area.  The  commissioner
     9  shall, by rule or regulation, define the term "residential area" as used
    10  in this subdivision.
    11    § 2. This act shall take effect immediately.
