Requires the department of transportation to collect data from third-party identification verification services used by airline passengers for expedited security screening in public-use airports and submit a quarterly report to the governor, the temporary president of the senate and the speaker of the assembly containing such data; defines terms.

AN ACT to amend the transportation law, in relation to third-party iden-
tity verification service reporting
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The transportation law is amended by adding a new section
2 14-o to read as follows:
3 § 14-o. Third-party identity verification service reporting. 1. For
4 purposes of this section, the following terms shall have the following
5 meanings:
6 (a) "Third-party identification verification service" shall mean a
7 privately operated identity verification service that utilizes biometric
8 data, including but not limited to fingerprint and facial recognition,
9 and secure credentialing to confirm the identity of individuals for the
10 purpose of facilitating expedited access to designated security check-
11 points at public-use airports.
12 (b) "Public-use airport" shall mean an airport available for use by
13 the general public without a requirement for the prior approval of the
14 owner or operator thereof except as may be required by federal law or
15 regulation.
16 (c) "Security breach" shall mean any instance where an individual
17 passes through a security checkpoint successfully while transporting a
18 restricted item, including but not limited to a concealed weapon.
19 2. Each third-party identification verification service operating in
20 the state shall, on a quarterly basis, provide to the department the
21 following information:
22 (a) the number of airline passengers who used a third-party identifi-
23 cation verification service for the purpose of receiving expedited
24 access through a security checkpoint at a public-use airport in the
25 state;

1 (b) the number of passengers who had their identity verified by a
2 transportation security administration officer while using a third-party
3 identification verification service;
4 (c) the number of passengers who were found to not have proper iden-
5 tification or a boarding pass by a transportation security adminis-
6 tration officer while using a third-party identification verification
7 service;
8 (d) the amount of security breaches that have occurred related to
9 passengers using a third-party identification verification service; and
10 (e) the number of functioning kiosks that each third-party identifica-
11 tion verification service maintains in each public-use airport in the
12 state.
13 3. The department shall submit a report on a quarterly basis to the
14 governor, the temporary president of the senate and the speaker of the
15 assembly which shall include the information provided to the department
16 pursuant to subdivision two of this section. In addition to such infor-
17 mation, the department shall also include in such report:
18 (a) data gathered from all public-use airports in the state relating
19 to the number of passengers who received expedited access security
20 screening without using a third-party identification verification
21 service; and
22 (b) any other information related to third-party identification
23 verification services the department deems necessary.
24 § 2. This act shall take effect immediately.
