        AN ACT to amend the public   service law,  in  relation  to  prohibiting
          electric  corporations and gas corporations from increasing charges to
          certain ratepayers due to legal or regulatory proceeding costs
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 66 of the public service law is amended by adding a
     2  new subdivision 33 to read as follows:
     3    33.  Prohibit  electric  corporations, gas corporations, and utilities
     4  from passing along costs or increasing charges to ratepayers  for  elec-
     5  tricity  and  natural  gas,  or  any associated goods and services, as a
     6  result of increased costs incurred  by  the  electric  corporation,  gas
     7  corporation,  or  utility due to legal or regulatory proceedings against
     8  such electric corporation, gas corporation, or  utility,  including  but
     9  not limited to settlements, attorneys' fees, penalties, fines or costs.
    10    §  2.    This act shall take effect on the sixtieth day after it shall
    11  have become a law.    Effective  immediately,  the  addition,  amendment
    12  and/or repeal of any rule or regulation necessary for the implementation
    13  of  this  act  on  its  effective  date  are  authorized  to be made and
    14  completed on or before such effective date.
